South Texas advocacy groups have launched a legal battle against a proposed land swap deal between the state and SpaceX. The deal, approved last month, has sparked controversy and opposition from local residents and the Carrizo Comecrudo Tribe.

What Happened: The contentious land swap would enable SpaceX to acquire 43 acres of Boca Chica State Park near its Brownsville spaceport. In exchange, the company would offer 477 acres adjacent to Laguna Atascosa National Wildlife Refuge, reported The Hill.

“This is just the latest example of our state officials failing to fulfill their obligations to Texans, whenever SpaceX is involved. Texas Parks & Wildlife Department’s duty is to protect parkland and wildlife resources, including at Boca Chica Beach and State Park. Protecting public parkland and the public’s interest means saying ‘no’ to the demands of SpaceX, whose space flight activities have caused harm to public lands and wildlife habitats,” the plaintiff’s attorney Marisa Perales said in a statement.

The lawsuit, filed last week, claims that the state failed to consider alternatives to the land swap during its negotiations with SpaceX, thereby neglecting to minimize potential harm to public lands. It also alleges that SpaceX does not currently own the 477-acre plot proposed for the swap. Earlier this year, The Texas Standard reported that SpaceX owner Elon Musk was in talks to acquire the land.

The deal has been met with resistance from local residents and the Carrizo Comecrudo Tribe, who have raised concerns about the privatization of popular public recreation land and the surrender of land considered sacred by the tribe.

Why It Matters: The proposed land swap comes at a time when SpaceX has been making significant strides in its operations. In February, Musk announced plans to land and sustain a million people on Mars. Later that month, SpaceX filed to shift its incorporation from Delaware to Texas, following a similar move by Musk’s other company, Neuralink.

In April, Musk emphasized the importance of the Starship in building a self-sustaining Mars city within the next 20 years. However, the company faced controversy when its Starlink technology was reportedly supplied to Russia via the black market.

The outcome of this lawsuit could have significant implications for SpaceX’s future operations in Texas and its broader ambitions in space exploration.
